In this process, parties reach an agreement with the assistance of a third-party neutral (mediator). This process allows open communication between the parties but often is handled in a “caucus-style” (where each party is in a different room and the mediator shuttles between rooms). This process allows parties to make agreements on all issues. Sometimes parties will mediate without attorneys. In that instance, usually at least one party must hire and pay for an attorney to draft a Court Order based on the agreement reached by the parties. Sometimes parties will mediate with attorneys present. Mediation often takes place after temporary orders are in place, all or most discovery has been completed, and a trial setting exists.
