What Processes Exist for Resolving Disputes?

"Kitchen Table" Process:

Direct negotiation between the parties. Parties reach an agreement with no outside assistance. This process can work if both parties are at a high-functioning point in their lives, are good communicators, and have the same knowledge and information regarding their finances and other matters. This is a difficult approach for most people because communication usually is difficult and because one party may feel less “powerful” or less knowledgeable. In most instances, neither party has an attorney; however, at least one party will have to hire and pay for an attorney to draft a Court Order based on the agreement reached by the parties. At this stage, the parties become aware of issues they did not address in their direct discussions.
